whim helps you meet nearby people for something simple and soon. these terms explain the deal between you and us. they're written plainly on purpose — please read them before you cast a spark.
1. agreeing to these terms
by downloading, opening, or using the Whim app (“Whim”, the “app”, “we”, “us”), you agree to these Terms of Use. if you don't agree, please don't use the app. if you're using Whim on behalf of someone else, you confirm you're allowed to accept these terms for them.
2. who can use whim
- you must be at least 18 years old.
- you must be able to form a binding contract where you live.
- you must not have been previously removed from Whim, or be barred from using it under any applicable law.
- you may hold one account, and it's personal to you — don't share it.
3. what whim is (and isn't)
Whim lets you cast a “spark” — an activity, roughly where you are, and a rough sense of “soon” — and matches you with one nearby person (Duet) or a small group (Quartet) who sparked something similar. if everyone accepts, you get a short, temporary chat to arrange where to meet, which expires automatically after 24 hours.
Whim is a tool for spontaneous, in-person meetups. it is not a dating service, a background-checking service, or a guarantee of anyone's identity, intentions, or safety. we don't vet, verify, or screen the people you're matched with.
4. meeting people — your safety
this is the important part. meeting people you don't know carries real-world risk, and you are responsible for your own safety. we strongly encourage you to:
- meet in public, well-populated places, especially the first time;
- tell a friend where you're going and who you're meeting;
- arrange your own transport and keep your phone charged;
- trust your instincts and leave any situation that feels wrong;
- never send money, share financial details, or hand over sensitive personal information to someone you've matched with.
Whim is not responsible for the conduct of any user, online or in person. you interact with other people at your own risk.
5. how you agree to behave
when you use Whim, you agree not to:
- harass, threaten, deceive, impersonate, or harm anyone;
- use Whim if you're under 18, or help anyone under 18 use it;
- use Whim for anything illegal, commercial soliciting, spam, or advertising;
- share content that is unlawful, hateful, sexually explicit, or that infringes someone else's rights;
- try to identify, track, or contact another user outside the bounds of what the app offers;
- scrape, reverse-engineer, overload, or otherwise interfere with the app or its systems.
6. location
Whim needs an approximate location to find people near you. we ask only for coarse location, and only when you cast a spark — never in the background. we store an approximate area rather than precise coordinates, and we show other users only a rounded, approximate distance — never a map, a pin, or your exact position. how we handle this is described in our privacy notice.
7. your chats and content
you own what you write. by sending messages or content through Whim, you give us a limited licence to store and transmit it so the app can work. match chats are temporary by design and are deleted after they expire. you're responsible for what you send, and you must have the right to send it.
8. reporting and removal
if someone behaves badly, please report them in the app. we may suspend or remove any account, with or without notice, where we reasonably believe these terms have been broken or where it's necessary to protect users.
9. the app is provided “as is”
we work hard to make Whim good, but we provide it “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. we don't promise the app will always be available, error-free, or that you'll be matched, that a match will accept, or that any meetup will happen or go well.
10. our liability
to the fullest extent permitted by law, Whim is not liable for any indirect or consequential loss, or for anything arising out of your interactions with other users, including anything that happens when you meet in person. nothing in these terms limits liability that can't be limited by law (such as for death or personal injury caused by our negligence, or for fraud).
11. ending things
you can stop using Whim and delete your account at any time from within the app. we may suspend or end your access if you break these terms. some sections — like safety, liability, and conduct — survive after you stop using Whim.
12. changes to these terms
we may update these terms as Whim grows. if we make a material change, we'll update the date above and, where appropriate, let you know in the app. continuing to use Whim after a change means you accept the updated terms.

a note while Whim is finding its feet: this is an early, good-faith version of our terms and will be reviewed by a lawyer before public launch. it does not yet name a governing-law jurisdiction or operating entity — those land with the launch build.
